Terms and Conditions for the Ridian App

Introduction

These Terms and Conditions (“Terms”) govern your use of the Ridian App (“App”), which is provided by Ubique Innovation AG, based in Zurich, Switzerland (“we”, “us”, “our”). By installing and using the App, you acknowledge and agree to these Terms. If you do not agree to the Terms, you are not permitted to use the App.

Ridian Services

Through the App, we provide services related to planning, completing, and reviewing tour experiences (“Services”). These include high-quality map material, tours verified by the Ridian Expert Network, tools for planning your own tours, and community features that allow you to share tour collections with connected users. The scope and availability of individual features may change at any time, particularly during the Early Access phase.

License and Restrictions

We grant you a personal, non-transferable, and non-exclusive license to use the App and its associated Services. You may not use, modify, distribute, or sell the Services or content for commercial purposes, or create derivative works from them.

User-Generated Content

Within the App, you can create your own tours, tour descriptions including photos, and tour collections (“User Content”) and share them with users you have previously connected with. You are solely responsible for the legality and accuracy of your User Content and represent that you have the necessary rights to it. By sharing it, you grant us a non-exclusive, worldwide, royalty-free license to store and display your User Content as part of the Services and make it accessible to the connected users you select. We reserve the right to remove User Content that violates these Terms or applicable law. We make no warranty as to the accuracy, completeness, or safety of tours shared by users.

Risk Notice for Tours and Outdoor Activities

You use maps, tours, and tour collections provided through the App or shared by connected users at your own responsibility and risk. Outdoor activities involve inherent risks, including changing weather and terrain conditions, trail conditions, avalanche or rockfall hazards, and your individual physical condition. Even tours verified by the Ridian Expert Network may no longer be accurate due to recent events. Before starting a tour, we recommend independently checking current weather, trail, and safety conditions, carrying appropriate equipment, and realistically assessing your own experience and physical condition. We make no warranty as to the accuracy, completeness, or timeliness of map material or tour descriptions.

Data Protection

Protecting your data is important to us. By agreeing to these Terms, you also agree to our Privacy Policy.

Limitation of Liability

We provide the Services “as is” without any express or implied warranty. We are not liable for any direct, indirect, incidental, special, or consequential damages, including personal injury or property damage, arising from the use of the Services or the completion of tours proposed or shared through the App. You acknowledge that map material and tour data are created partly through automated processes and based on User Content and are not always subject to manual review.

Copyright and Proprietary Rights

The App and all associated Services are protected by copyright, trademarks, and other intellectual property rights. These Terms do not grant you a license to use our intellectual property except for the rights expressly granted in these Terms.

Changes to the Terms of Use

We reserve the right to change these Terms at any time, particularly in connection with the further development of the App after the Early Access phase, such as when introducing paid features. Your continued use of the App after a change means that you agree to the new Terms. It is your responsibility to check for changes regularly.

Final Provisions

These Terms are governed by the laws of Switzerland, and any disputes arising from these Terms will be decided by the competent courts in Zurich. These Terms constitute the entire agreement between you and us and supersede all previous agreements concerning the use of the App.
